(Legally Binding Agreement between Vishwakarma Employment Service Pvt. Ltd. (“Company”) and Service Providers / Users (Candidates) using the WEBEST Portal)

1. Registration & Information
1.1 All Service Providers and Users shall ensure that the information submitted on the WEBEST PORTAL is accurate, complete, and up to date.
1.2 Service Providers are solely responsible for verifying the authenticity of candidates’ documents and qualifications submitted through their accounts.
1.3 Users (candidates) are responsible for ensuring that their personal, educational, and professional details are true and verifiable.
1.4 Any false, misleading, or incorrect information shall result in rejection, suspension, or cancellation of the account/registration without refund.
1.5 The Company facilitates employment opportunities but does not guarantee job placement or selection, which rests solely with private employers.
1.6 All data submitted through the WEBEST PORTAL becomes the exclusive property of the Company.
2. Company Rights
2.1 The Company may amend processes, eligibility criteria, terms, and conditions at any time without prior notice.
2.2 The Company has the right to suspend, block, or terminate the account of any Service Provider or User.
2.3 All decisions of the Company shall be final and binding.
2.4 The Company may remove any candidate profile or service provider account without assigning a reason.
2.5 The platform, its brand, design, and all associated data remain the exclusive property of the Company.
3. Confidentiality & Data Security
3.1 The Company may collect, process, and use personal and non-personal data in accordance with its Privacy Policy.
3.2 Data shall be used only for providing services, employment facilitation, compliance, security, or promotional purposes.
3.3 Full ownership of all data rests with the Company; neither Service Providers nor Users shall claim any rights over it.
4. User Responsibilities (Candidates)
4.1 Users shall provide accurate personal, educational, and employment-related information while registering.
4.2 Users shall not upload fake, fraudulent, or misleading documents.
4.3 Users understand that the Company only provides employment facilitation and is not responsible for interview outcomes or job offers.
4.4 Users shall maintain confidentiality of their login credentials and shall not share accounts.
4.5 Users agree not to misuse the platform, including but not limited to spamming, misrepresentation, or attempting to exploit services.
5. Service Provider Responsibilities
5.1 Service Providers shall only submit genuine data and candidate applications.
5.2 They shall not misuse the portal for fraudulent, misleading, or unauthorized activities.
5.3 Service Providers shall indemnify and hold harmless the Company for any liability arising from false submissions, misconduct, or breach of terms.
5.4 They must comply with all procedures, policies, and legal requirements communicated by the Company.
6. Fees, Penalties & Refunds
6.1 Registration Fee (Mandatory): A one-time non-refundable fee of ₹100 shall be payable by both Service Providers and Users (candidates) at the time of registration.
6.2 Registration shall be renewed annually with payment of ₹100. Non-payment shall result in automatic suspension or termination.
6.3 No additional form fees shall be charged.
6.4 Subscription Plans (Optional for Service Providers): Paid monthly/annual subscription plans may be offered for premium benefits such as increased visibility, lead access, or premium tools.
6.5 The Company may impose penalties, fines, or recover dues in case of misconduct, non-payment, or breach of terms.
6.6 Refund Policy: All fees paid (registration or subscription) are non-refundable, except where expressly stated in writing by the Company.
7. Prohibited Activities
7.1 Users and Service Providers shall not engage in illegal, fraudulent, or misleading activities through the WEBEST PORTAL.
7.2 Any violation shall result in immediate account suspension or termination without refund.
7.3 Users and Service Providers shall be liable for any damage caused to the reputation of the Company.
8. Non-Compete Clause (Service Providers)
8.1 Service Providers shall not provide similar services outside the WEBEST platform that directly conflict with the Company’s business interests.
8.2 Violation shall result in termination and the Company may claim damages.
9. Liability & Indemnity
9.1 The Company acts only as a facilitator between Users and employers/service providers. Final hiring decisions rest entirely with employers.
9.2 The Company is not liable for rejection, non-selection, or any outcome of job interviews.
9.3 Service Providers and Users shall indemnify the Company against all claims, damages, or expenses arising from false information, breach of terms, or misconduct.
9.4 No User or Service Provider shall initiate legal proceedings against the Company for non-selection or cancellation of account.
10. Force Majeure
The Company shall not be liable for non-performance or service failure due to events beyond its control, including natural disasters, strikes, wars, lockdowns, or technical failures.
11. Governing Law & Dispute Resolution
11.1 This Agreement shall be governed by the laws of India.
11.2 Exclusive jurisdiction shall lie with competent courts at Bilaspur, Yamunanagar, Haryana.
11.3 Any dispute shall first be referred to arbitration under the Arbitration and Conciliation Act, 1996, conducted in Bilaspur, Yamunanagar, Haryana.
11.4 Users and Service Providers cannot claim damages against the Company for non-provision of employment or account suspension.
12. Final Provisions
12.1 Registering on the WEBEST PORTAL and paying applicable fees constitutes full acceptance of these Terms & Conditions.
12.2 This Agreement forms the complete and binding contract between Vishwakarma Employment Service Pvt. Ltd. and Service Providers/Users.
12.3 The Company reserves all rights, while Service Providers and Users’ responsibilities are clearly defined herein.
12.4 Employment facilitation depends solely on candidate qualifications and employer opportunities; no guarantee of selection is made.
12.5 All payments made are non-refundable and solely the responsibility of the payer.
